1 Acceptance of Terms

By inviting DuckBot to a server, configuring it, or interacting with it in any way, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. Server administrators who add the Bot accept these Terms on behalf of their server.

2 Description of Service

DuckBot is a points-tracking ("karma") bot for Discord that lets users assign points to entities using a command syntax such as @goodstuff++. The Bot is operated by Duck Bot LLC, a Tennessee limited liability company ("the Operator," "we," "us," or "our"). Configuration and administration of the Bot are handled through Duck Bot LLC.

3 Eligibility

To use DuckBot you must be at least 13 years old, or the minimum age of digital consent in your country, and you must comply with Discord's Terms of Service and Community Guidelines. You are responsible for ensuring your use of the Bot complies with all applicable laws and with the rules of any server in which you use it.

4 Acceptable Use

When using DuckBot, you agree not to:

• Use the Bot to harass, abuse, defame, or harm others, or to assign points in a manner that violates Discord's rules or a server's rules.
• Attempt to exploit, manipulate, or artificially inflate point values through automation, scripting, or abuse of the point-award mechanic.
• Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Bot, its infrastructure, or related systems.
• Reverse engineer, decompile, or attempt to extract the source code of the Bot, except where such restriction is prohibited by law.
• Use the Bot for any unlawful purpose or in violation of these Terms.

We may suspend or terminate access for any user or remove the Bot from any server that violates these provisions.

5 Configuration and Administration

Configuration of the Bot is administered through Duck Points LLC. Server administrators are responsible for how the Bot is configured and used within their servers, including which channels it operates in and how the point mechanic is applied. We are not responsible for the conduct of server administrators or members, or for how points are assigned within any server.

6 Points Have No Monetary Value

Points tracked by DuckBot are for entertainment and community purposes only. They have no monetary or real-world value, cannot be exchanged, purchased, redeemed, or transferred for anything of value, and confer no ownership or other rights. We may adjust, reset, or remove point values at our discretion.

7 Data and Privacy

Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Bot, you also consent to the data practices described there.

8 Availability, Changes, and Termination

The Bot is provided on an "as available" basis. We may modify, suspend, discontinue, or remove the Bot or any of its features from any server at any time, with or without notice. We may also terminate or restrict your access to the Bot at any time, including for violations of these Terms. You may stop using the Bot at any time by removing it from your server.

9 Disclaimer of Warranties

DuckBot is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Bot will be uninterrupted, error-free, secure, or free of data loss.

10 Limitation of Liability

To the maximum extent permitted by applicable law, Duck Bot LLC and its members, officers, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, points, profits, revenues, business opportunities, or goodwill, arising out of or relating to the Bot, these Terms, or your use of or inability to use the Bot, regardless of the legal theory asserted and even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the total aggregate liability of Duck Bot LLC and the parties identified above for all claims arising out of or relating to the Bot or these Terms shall not exceed one hundred United States dollars (US $100). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

11 Indemnification

You agree to indemnify and hold harmless Duck Bot LLC and Duck Points LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Bot, your violation of these Terms, or your violation of any rights of another party or any applicable law.

12 Intellectual Property

DuckBot, including its name, branding, and underlying software, is owned by Duck Bot LLC. These Terms do not grant you any right, title, or interest in the Bot other than the limited right to use it in accordance with these Terms.

13 Governing Law and Venue

These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Tennessee, United States of America, without regard to its conflict-of-laws principles. To the extent permitted by law, the exclusive venue for any legal action or proceeding shall be a court located in Hamilton County, Tennessee, United States of America, and you consent to the exclusive personal jurisdiction of the courts located in Hamilton County, Tennessee, United States of America.

14 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable or, if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

15 Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by an updated "Last updated" date. Your continued use of the Bot after changes take effect constitutes acceptance of the revised Terms.
